VOLUNTEER RELEASE AND WAIVER OF LIABILITY

THIS RELEASE AND WAIVER OF LIABILITY (the "Release") is executed on the date below, by the undersigned volunteer (the "Volunteer") in favor of Hui O Hawaii San Diego, a non-profit corporation, its directors, employees and agents (collectively "HUI O HAWAII SAN DIEGO"). The Volunteer desires to work as a volunteer for Hui O Hawaii San Diego and engage in the activities related to being a volunteer. As an inducement to Hui O Hawaii San Diego to accept the Volunteer's offer of volunteer work, the Volunteer does hereby freely execute this Release under the following terms.

1. Waiver and Release: The Volunteer does hereby and forever release and hold harmless Hui O Hawaii San Diego and its successors and assigns from any and all liability, claims, suits and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise, either directly or indirectly, as a result of the Volunteer's work for Hui O Hawaii San Diego. The Volunteer understands and acknowledges that this Release discharges Hui O Hawaii San Diego from any liability or claim that the Volunteer may have against Hui O Hawaii San Diego with respect to any bodily injury, personal injury, illness, death or property damage that may result from the Volunteer's work with Hui O Hawaii San Diego, whether caused by the actions or negligence of Hui O Hawaii San Diego or its officers, directors, employees, other volunteers, vendors, agents, or otherwise. The Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of California, and that this Release shall be governed by and interpreted in accordance with the laws of the State of California.

2. Sexual Harassment Policy: Hui O Hawaii San Diego strictly prohibits any conduct that constitutes sexual harassment and will take appropriate action against any person involved in such conduct. Any person who believes he or she has been subjected to sexual harassment should immediately report the incident to the Executive Director or the President of the Board.

3. Photographic Release: The Volunteer hereby grants and conveys unto Hui O Hawaii San Diego the right to freely reproduce and/or circulate any photographs or other recordings of the Volunteer for any lawful purpose. The Volunteer shall not be entitled to any compensation therefore, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
